Illinois Attorney General Secures $1 Million Settlement Against Midway Staffing for Worker Wage Violations

Illinois Attorney General Kwame Raoul has announced a significant $1 million settlement with Midway Staffing Inc., concluding allegations that the temporary staffing agency participated in illegal no-poach agreements and wage-fixing schemes that harmed workers. The settlement provides compensation for temporary employees affected by these unlawful employment practices.

This resolution represents the final component of a comprehensive 2020 lawsuit initiated by the Attorney General’s office targeting anticompetitive practices in the staffing industry. The original litigation named four defendants: Midway Staffing Inc., Elite Staffing Inc., Metro Staff Inc., and their client company Colony Display LLC.

According to the legal action, these staffing agencies allegedly conspired to restrict workers’ ability to seek improved employment opportunities and benefits through coordinated no-poach agreements. The complaint further alleged that Colony Display actively facilitated and enforced these anticompetitive arrangements, creating a system that suppressed worker mobility and wage competition.

The Midway settlement concludes the multi-defendant case, bringing the total financial recovery from all four entities to $5.5 million. This substantial aggregate settlement demonstrates the state’s commitment to protecting worker rights and combating employer practices that artificially suppress wages and limit employment opportunities.
