A negligence lawsuit has been filed against a construction company alleging its failure to properly maintain cooling tower systems contributed to a deadly Legionnaires’ disease outbreak in Harlem that has claimed five lives and sickened over 100 people. The litigation claims inadequate stormwater cleaning following major July storms allowed dangerous Legionella bacteria to proliferate in untreated water systems.

Outbreak Scope and Public Health Impact

As of August 19, the outbreak has resulted in 108 confirmed Legionnaires’ disease cases and five fatalities, with dozens of victims requiring hospitalization. Construction workers who contracted the severe pneumonia-like illness are among those represented in the legal action seeking compensation for their injuries and medical expenses.

City health officials have identified 12 cooling towers in central Harlem that tested positive for Legionella bacteria and confirmed these systems as the outbreak’s source, though specific triggering factors remain under investigation.

The lawsuit alleges the construction company failed to properly clean stormwater from cooling towers at Harlem Hospital and nearby buildings following several major storms in July. This negligent maintenance allegedly created ideal conditions for Legionella bacteria growth in stagnant, untreated water systems.
