The estate of Marie Eltz has initiated legal proceedings against Neshaminy Manor, alleging chronic understaffing and negligent care contributed to the 92-year-old resident’s death following a fall at the Bucks County-operated nursing facility. The wrongful death litigation, recently filed in the U.S. District Court for the Eastern District of Pennsylvania, names multiple defendants including Bucks County government, Neshaminy Manor, and Genesis HealthCare LLC, the private contractor responsible for staffing the 360-bed Warrington facility.
According to court documents, nursing staff allegedly failed to implement appropriate fall prevention protocols upon Eltz’s admission despite her documented fall risk factors. The complaint further alleges that following a Valentine’s Day 2023 incident where Eltz fell from her wheelchair, staff inadequately investigated her pain complaints, resulting in delayed diagnosis of a hip fracture and subsequent complications that ultimately proved fatal.
The lawsuit presents evidence from Medicare documentation indicating that Neshaminy Manor operated with insufficient staffing levels throughout Eltz’s residency period. These staffing deficiencies allegedly enabled the county to achieve significant cost savings while providing substandard care that failed to meet established nursing home industry standards and regulatory requirements.
